What Is Mediation?

Mediation is a process through which legal matters are resolved out-of-court. They are handled by a trained, certified neutral third party who is tasked with going between the parties in order to settle on an agreement in any aspect of a family law case or divorce, such as child custody or property division. The parties are expected to remain respectful and engage in some give-and-take in order to reach a resolution.

There are situations where a mediation breaks down and the case goes back to court. However, the majority of couples who agree to use mediation to settle their divorce issues are successful in resolving them through mediation.

Benefits Of Mediation

There are many benefits of settling a case through mediation. Since mediation is not dependent on the schedule of the court, the parties can agree to times and dates of meetings. This allows the process to move forward more quickly. Also, as a mediator is working between the parties, mediation typically places less stress on everyone involved, including any children of the marriage being dissolved.
